1. Agreement to Terms

By accessing this website, requesting a quote, scheduling services, submitting your contact information, communicating with us, or using services provided by Cuttin Up (“Company,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service.

If you do not agree to these Terms, you should not use our website, submit information, request services, or engage our services.

Cuttin Up operates as a DBA based in the State of Alabama.


2. Services Provided

Cuttin Up provides tree and outdoor property services, which may include but are not limited to:

Tree removal

Tree trimming and pruning

Stump grinding and stump removal

Emergency tree services

Storm cleanup

Property cleanup

Debris removal

Related outdoor services

All services are subject to availability, weather conditions, site conditions, equipment access, safety considerations, and final approval by Cuttin Up.


3. Estimates and Pricing

Estimates are based on the information available at the time of inspection, quote request, photo review, or customer communication.

Final pricing may change if additional or unforeseen conditions are discovered, including but not limited to:

Hidden decay, rot, or structural weakness

Dangerous tree conditions

Limited equipment access

Underground utilities, irrigation, drainage, or other hidden property features

Fencing, structures, vehicles, landscaping, or other obstacles

Additional work requested by the customer

Changes in job scope

Weather-related complications

Safety concerns

Estimates are valid only for the time period stated on the estimate. If no expiration date is listed, estimates are generally valid for 7 to 30 days at the discretion of Cuttin Up.

Written, electronic, verbal, or text-message approval may be required before work begins.


4. Customer Approval

By approving an estimate, quote, invoice, work order, text message agreement, or other authorization, the customer authorizes Cuttin Up to perform the agreed-upon services.

The customer is responsible for ensuring they have the legal authority to authorize work on the property, including tree removal, trimming, stump grinding, or any related services.

Cuttin Up is not responsible for disputes between property owners, tenants, landlords, neighbors, homeowners associations, municipalities, or other parties regarding whether the customer had permission to authorize the work.


5. Payments

Payment is due upon completion of services unless otherwise agreed in writing.

Cuttin Up may accept forms of payment including, but not limited to:

Cash

Check

Zelle

Electronic payment methods approved by Cuttin Up

Cuttin Up reserves the right to require a deposit before scheduling or beginning certain jobs, including larger jobs, emergency jobs, equipment-heavy jobs, or jobs requiring special preparation.

Late or unpaid balances may result in collection efforts, additional fees, interest, or legal action as permitted by applicable Alabama law.

Returned checks, failed payments, chargebacks, or disputed payments may be subject to additional fees.


6. Cancellations and Rescheduling

Customers should provide at least 24 hours’ notice for cancellations or rescheduling whenever possible.

Cuttin Up reserves the right to charge a cancellation fee if a customer cancels after crews, equipment, subcontractors, or materials have already been scheduled or dispatched.

Cuttin Up may reschedule services due to:

Weather conditions

Safety concerns

Equipment issues

Crew availability

Emergency service calls

Site access issues

Other circumstances beyond our control


7. Property Access and Customer Responsibilities

The customer agrees to provide safe and reasonable access to the work area.

Before work begins, the customer is responsible for:

Moving vehicles, trailers, boats, outdoor furniture, decorations, or other obstacles

Securing pets and children away from the work area

Identifying underground utilities, irrigation lines, septic systems, drainage systems, landscape lighting, invisible fences, or other hidden items

Notifying Cuttin Up of known hazards

Providing gate access, entry codes, or other required access information

Confirming property lines and ownership where relevant

Cuttin Up is not responsible for damage to undisclosed, unmarked, hidden, buried, fragile, deteriorated, or pre-existing property conditions.


8. Underground Utilities, Irrigation, and Hidden Hazards

Tree work, stump grinding, debris removal, and equipment movement can involve risks to underground or hidden property features.

The customer is responsible for notifying Cuttin Up of any underground or hidden items, including but not limited to:

Irrigation lines

Drainage pipes

Septic tanks or drain fields

Electrical lines

Gas lines

Water lines

Cable or internet lines

Landscape lighting

Invisible pet fencing

Sprinkler heads

Buried structures or materials

Cuttin Up is not responsible for damage to underground or hidden items that were not clearly disclosed, marked, or identified before work began.


9. Tree Conditions and Natural Risks

Trees are living organisms and may contain hidden conditions that are not visible during inspection, including decay, cavities, root damage, disease, pest damage, cracks, weak unions, or internal structural defects.

Cuttin Up is not responsible for damage, delays, or additional costs caused by hidden defects, unstable trees, falling limbs, root failure, weather, or other natural conditions that could not reasonably be identified before work began.


10. Debris Removal and Cleanup

Debris removal and cleanup will be performed according to the agreed-upon scope of work.

Unless specifically included in the estimate, services may not include:

Hauling away all debris

Raking the entire yard

Removing sawdust or stump grindings

Leveling soil

Replacing sod, mulch, landscaping, or hardscaping

Repairing lawn impressions caused by equipment

Removing debris created by others

If debris is to remain on-site, the customer is responsible for any further disposal or cleanup unless otherwise agreed.


11. Lawn, Landscape, and Property Impact

Tree work and equipment use may cause reasonable and unavoidable impact to lawns, soil, driveways, landscaping, fences, or surrounding areas.

Cuttin Up will make reasonable efforts to minimize property impact. However, the customer understands that heavy equipment, falling limbs, stump grinding, dragging debris, and other tree work activities may cause marks, ruts, impressions, broken small branches, disturbed mulch, or other incidental effects.

Cuttin Up is not responsible for ordinary or unavoidable property impact related to performing the agreed-upon work.


12. Permits, Homeowners Associations, and Local Requirements

The customer is responsible for determining whether any permits, approvals, homeowners association permissions, municipal approvals, or neighbor permissions are required unless Cuttin Up specifically agrees in writing to handle such requirements.

Cuttin Up may assist with permitting or approvals when agreed upon, but the customer remains responsible for providing accurate property information and ensuring legal authorization for the requested work.

Cuttin Up is not responsible for fines, penalties, disputes, or delays caused by missing, denied, or incorrect approvals unless otherwise required by law.


13. Emergency Services

Emergency services may be subject to premium pricing due to urgency, risk, scheduling disruption, weather conditions, after-hours response, or hazardous work conditions.

Emergency services may require immediate verbal, written, text-message, or electronic authorization.

Cuttin Up reserves the right to refuse, delay, or stop emergency work if conditions are unsafe.


14. Insurance and Licensing

Cuttin Up maintains appropriate insurance coverage for its business operations as required or applicable under Alabama law.

Proof of insurance may be provided upon request.

The customer understands that tree work involves inherent risk. Cuttin Up will use reasonable care, appropriate equipment, and safe work practices when performing services.


15. Limitation of Liability

To the fullest extent permitted under Alabama law, Cuttin Up shall not be liable for:

Pre-existing property damage or deterioration

Hidden defects in trees, limbs, roots, soil, or structures

Damage to undisclosed or unmarked utilities, irrigation, septic systems, or underground items

Damage caused by weather, storms, wind, rain, lightning, or other acts of nature

Delays caused by weather, safety concerns, equipment issues, or circumstances beyond our control

Neighbor, landlord, tenant, HOA, or property-line disputes

Ordinary and unavoidable effects of tree work or equipment use

To the fullest extent permitted by law, Cuttin Up’s total liability for any claim related to services shall not exceed the amount paid by the customer for the specific service giving rise to the claim.


16. SMS/Text Messaging Terms

By providing your phone number and opting in to receive communications, you consent to receive SMS/text messages from Cuttin Up.

Message types may include:

Appointment confirmations

Appointment reminders

Estimate follow-ups

Job updates

Customer service messages

Scheduling messages

Promotional offers, when applicable and only where permitted

Message frequency may vary.

Message and data rates may apply.

You may opt out at any time by replying STOP.

For help, reply HELP or contact us directly.

Consent to receive SMS messages is not a condition of purchase.

Cuttin Up does not sell, rent, or share your phone number with third parties for their marketing purposes.


17. Consent to Communications

By submitting your contact information through our website, forms, advertisements, phone calls, text messages, emails, or other communication channels, you consent to receive communications from Cuttin Up, which may include:

Phone calls

Text messages

Emails

Voicemail messages

Follow-up communications related to requested services

You may opt out of marketing communications at any time.

21. Indemnification

You agree to indemnify, defend, and hold harmless Cuttin Up, its owners, workers, contractors, representatives, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses arising from:

Your misuse of our website or services

Your failure to disclose hazards or property conditions

Your lack of authority to authorize work

Property disputes involving ownership, boundaries, tenants, neighbors, HOAs, or municipalities

Your violation of these Terms

Your violation of applicable laws or regulations


22. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Alabama.

Any disputes related to these Terms, the website, estimates, invoices, communications, or services provided by Cuttin Up shall be handled in the appropriate courts located in Alabama, unless otherwise required by applicable law.

Both parties agree to attempt good-faith resolution before filing legal action whenever reasonably possible.


23. Force Majeure

Cuttin Up shall not be liable for delays, cancellations, or failure to perform caused by events beyond our reasonable control, including but not limited to:

Severe weather

Storms

Natural disasters

Equipment failure

Labor shortages

Supply shortages

Power outages

Road closures

Government restrictions

Emergencies

Unsafe working conditions


24. Changes to These Terms

Cuttin Up reserves the right to update or modify these Terms at any time.

Updates will be posted on the website with a revised effective date. Continued use of the website or services after updates are posted means you accept the revised Terms.
